Terms of Service

1) Accounts and eligibility

Age & authority: You must be 13+ to use the Services. If you are under the age of majority where you live, your parent/guardian must accept these Terms on your behalf. You represent that you have authority to bind any organization on whose behalf you use the Services.

Account security: Keep your credentials confidential and use strong security. You are responsible for all activity under your account. Notify us immediately of unauthorized use.

Prohibited persons: You may not use the Services if you are located in, under the control of, or a national/resident of any embargoed country or on any U.S. or applicable sanctions list.

2) The Service; inputs and outputs; licenses

Your Content: You may submit prompts, files, and other content (Input). The Services generate AI-assisted Output. Input and content you upload are Your Content.

License to us: To operate and secure the Services, you grant GoFreeChat a worldwide, royalty-free, sublicensable license to host, process, transmit, display, and store Your Content and Output, and to use related meta-data and usage signals, solely to provide, maintain, protect, and improve the Services; comply with law; and as otherwise described in the Privacy Policy.

Your rights to Output: Subject to these Terms and applicable law, GoFreeChat assigns to you its rights, if any, in the Output generated for your Input, excluding any pre-existing IP in the models, Services, or third-party content. Other users may independently receive similar output; you acknowledge Output may not be unique.

Attribution & disclosures: Do not misrepresent Output as purely human-generated. If you publish substantial Output, clearly disclose that AI was used.

Reservation of rights: GoFreeChat and its licensors retain all rights in the Services, including software, models, safety systems, logos, and documentation.

3) Acceptable use

To keep GoFreeChat safe, reliable, and lawful, you agree to the Acceptable Use Policy (AUP) when accessing the Services or using Output. These rules apply to all users and all tiers (free and Pro).

Prohibited content includes: illegal content/activity; exploitation of minors; hate/harassment/incitement; non-consensual intimate imagery; doxxing; IP infringement; fraud/deception/deepfakes without disclosure; malware/hacking; instructions for physical harm; unqualified professional advice; scraping/automation without permission; reverse engineering; bypassing rate limits/safety systems; and spam/traffic arbitrage.

4) Subscriptions; billing; taxes; refunds

Auto-renewal: Pro is billed in advance and renews automatically until canceled. Taxes may apply.

Payment processor: We use a third-party processor (e.g., Stripe). By subscribing, you authorize recurring charges to your payment method until you cancel.

Cancellations & refunds: You may cancel at any time; cancellation is effective at the end of the current billing period. Fees are non-refundable except where required by law. We may issue goodwill credits at our discretion.

Chargebacks: If you initiate a chargeback we may suspend your account pending resolution and may treat the chargeback as a termination for breach.

5) Service changes; availability; beta features

We may add, remove, or modify features at any time; we may discontinue the Services (in whole or part) with reasonable notice where practicable. Beta/experimental features may be offered and may break or change; use them at your own risk.

Uptime & support: No specific uptime or support SLAs are provided unless we agree in writing.

6) Third-party services and integrations

Your use of third-party services (e.g., sign-in providers, storage, social platforms, or model runtimes) is subject to their terms. We are not responsible for third-party services. See the Privacy Policy for how we share data with service providers and model/runtime vendors.

7) Safety; high-risk use disclaimer

The Services are not designed for high-risk contexts (e.g., medical diagnosis/treatment, aviation, nuclear, autonomous vehicles, critical infrastructure). Do not rely on Output where errors could lead to death, personal injury, or severe damage.

8) Intellectual property; feedback; DMCA

Ownership: Except for Your Content and your rights to Output described above, the Services and all related IP are owned by GoFreeChat and its licensors.

Feedback: If you choose to give feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or compensation.

DMCA: To submit a DMCA notice or counter-notice, email legal@gofreechat.ai with: (i) your contact info; (ii) identification of the work claimed infringed; (iii) the material to be removed and its location; (iv) a statement of good-faith belief; (v) a statement under penalty of perjury of accuracy and authority; and (vi) your physical or electronic signature.

9) Privacy; data use

Your use of the Services is governed by our Privacy Policy. By using the Services, you also consent to the data use described there, subject to applicable consent/opt-out rights.

10) Disclaimers; AI limitations

THE SERVICES AND ALL OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. OUTPUT MAY BE INCORRECT, BIASED, OFFENSIVE, OR UNSAFE. DO NOT RELY ON OUTPUT FOR MEDICAL, LEGAL, FINANCIAL, OR OTHER PROFESSIONAL ADVICE.

11) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOFREEGPT AND ITS AFFILIATES, SUPPLIERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO GOFREEGPT FOR PRO IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $100.

12) Indemnification

You will defend, indemnify, and hold harmless GoFreeChat and its affiliates, officers, directors, employees, and agents from any claims, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to Your Content, your use of the Services, or your breach of these Terms or applicable law.

13) Miscellaneous

Changes: We may modify these Terms from time to time. When we do, we will update the "Last updated" date at the top of the Terms. If we make material changes to your rights or obligations, we will use reasonable efforts to provide notice and will take any additional steps required by law.

Assignment: You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.

Force majeure: We are not liable for delays or failures due to events beyond our reasonable control (e.g., outages, natural disasters, war, labor disputes, government actions).

Severability; waiver: If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce any provision is not a waiver.

Notices: We may send notices to the email associated with your account or via in-product messaging. You consent to electronic communications from us.

Entire agreement: These Terms, the Privacy Policy, and any product-specific terms or policies referenced herein constitute the entire agreement between you and us regarding the Services.
